Giant Leap Forward for Federal Employees Bargaining Rights

The American Federation of Government Employees (AFGE) called the recent D.C. District Court ruling “a major step toward restoring federal employees’ legally guaranteed collective bargaining rights.”


In a statement, AFGE National President Everett Kelley congratulated NTEU on their legal victory against the Trump administration’s executive order and emphasized that AFGE looks forward to arguing its own case in court. Kelley expressed confidence that these combined legal efforts will help fully protect federal workers’ rights and send a clear message that no administration is above the law.

Judge Rules Mass Firing of Probationary Employees Illegal- A Win For AFGE

A federal judge ruled on Feb. 27 that the Office of Personnel Management (OPM) had no authority to fire federal employees in other agencies, declaring its actions illegal and ordering the immediate reversal of terminations. Judge William Alsup stated that firing employees without cause was unjust and that agencies should not fabricate performance issues to justify dismissals. He ordered OPM to notify affected agencies, including the VA, DOD, and SBA, and disclose details of a Feb. 13 call where agencies were allegedly instructed to fire probationary employees. The ruling follows a Merit Systems Protection Board (MSPB) decision that had already paused some terminations. AFGE and other unions, who fought the case, called it a major victory against the administration’s efforts to privatize federal jobs.

Many of you have already received, or will soon receive, an email from a U.S. Office of Personnel Management (“OPM”) email address hr@opm.gov titled "What did you do last week?" This email requests all federal employees to respond with approximately five bullet points detailing their work over the past week. No explanation has been provided regarding how this information will be used or why it is being requested. While a message on X from Elon Musk suggested that failure to respond would be considered a resignation, the OPM email itself does not contain this threat, and there is no known authority for Mr. Musk to make this claim.


AFGE strongly believes this email was sent illegitimately and that OPM lacks the authority to direct the assignment of work to agency employees in this manner. We will formally request that OPM rescind the email and clarify under what…
