Employee Rights Review- Temporary Promotions

More than every we are seeing employees being detailed to other areas or positions. Although management does have this right, we must ensure that employees are well compensated when they are detailed to higher-graded duties. Let's explore Article 12 Section 2 of the Master Agreement to learn more:


  1. If employees are being detailed to a higher-graded position for a period of more than 10 consecutive work days, they must be temporarily promoted.

  2. The temporary promotion should be initiated at the earliest date the department knows that your detail will exceed 10 consecutive work days, payment should must on the first day of the detail.

  3. The agency must not rotate employees into the higher-graded position for less than 10 days for the purpose of avoiding the higher rate of pay.

  4. For GS employees: this section applies when they perform the grade-controlling duties of a higher-graded position for at least 25% of their time for 10 consecutive work days.

  5. For FWS employees (Wage Grade): this section applies when the employee performs higher-graded duties on a regular and recurring basis.

  6. For title 38 or Hybrid title 38 employees: according to the contact, employees who are detailed detailed to higher-graded assignments must be referred, at the effective date of detail, to a PSB for expedited promotion consideration, however the PSB has been eliminated this year, which implicates that this responsibility should fall back on the manager. ( According to the contract, PSB board will be held within 30 days of the effective date of the detail and that the approving official should issue the decision as soon as possible, the implication is that with the PSB dissolution, the approving official should be the manager in leu of the PSB).

  7. For title 5 employees: temporary promotions in excess of 120 calendar days shall be filled through competitive procedures as per Article 23. It is presumed by this article that title 5 employees should not be temporarily promoted for more than 120 calendar days unless he will be permanently promoted to such position thereafter.


If you are being detailed to a position for more than 10 consecutive work days, reasonably believe that you will be completing higher-graded duties and have not received notification for temporary promotion, please let us know right away. Although it is not guaranteed, you may be entitled to a temporary promotion and back pay since the start of higher-graded duties.
